The Elements of a Premises Liability Case in New York

|

Premises Liability New York

Property owners are held accountable for providing a safe environment for any tenants, visitors, or customers on their premises. Unfortunately, safety issues do occur, resulting in significant injuries. However, if the owner or manager of the property knowingly fails or neglects to resolve safety problems, those who are injured can recover financial compensation.

To determine if you have the grounds to file a premises liability lawsuit, the following elements need to be established:

  • You were lawfully on the property. The owner invited you or hired you to perform work on the property. If you were not lawfully on the property, you will need to prove that the owner was aware that you were trespassing.
  • The property owner was negligent in fixing the unsafe condition. You must prove that the owner knew or should have known about the issue. However, he or she has failed to provide repairs or adequate warning about the issue. If the owner did make repairs, you must demonstrate that they weren’t sufficient or worsened the problem.
  • The negligence caused your injury.

If you or a loved one has sustained a significant injury while on someone else’s property, our attorneys are ready to offer you their legal advice. For over a decade, we have been helping those in similar situations pursue justice by providing them the relentless and personalized legal counsel they deserve.
